Protected Health Information (PHI): Privacy, Security, and Confidentiality Best Practices

Protected Health Information (PHI) is any health information that could identify an individual, whether it is recorded electronically, in paper, or through oral communication. It consists of a patient’s name, date of birth, medical record number, diagnosis, treatment, photographs, and contextual information, such as units and/or admission dates. Health Insurance Portability and Accountability Act (HIPAA) of 1996 provides guidelines on how HIPAA-regulated organizations (CDC, 2024) use and disclose PHI. HIPAA states that only individuals who provide direct care to a patient or those who have been approved by the patient should have access to their PHI. Consequences for violations can be serious, such as termination from employment, fines, or loss of professional license, if patient information is shared on social media or through unauthorized means.

Confidentiality Laws

• Private information – patient’s right to control personal health information. An example of this is letting the wrong relatives know that a patient is in an intensive care unit (ICU). Establishing patient privacy is the key to patient trust and safe, effective, high-quality care (Tegegne et al., 2022).
• Security is the technical protection that will safeguard electronic PHI. An open shared computer with an ICU EHR on it can be subject to unauthorized access, potential security protocol violations, etc. HIPAA has a security rule, which specifically protects electronic PHI (CDC, 2024).
• Confidentiality: The responsibility not to share information unless it is with those who are directly involved in the care of the person. Confidentiality may be violated if the general public posts comments on patients in the ICU on social media. Confidentiality of patients is a professional, ethical, and legal obligation of healthcare professionals and a key component of care excellence (Tegegne et al., 2022).
• All team members – doctors, nurses, therapists, and IT staff must collaborate in the protection of PHI in the ICU through reporting, policies, and secure documentation.

• Interdisciplinary Cooperation: Nurses, physicians, IT, compliance, H, R and leadership must cooperate to safeguard PHI and ensure accountability.

Mitigation of Risks

• Audit Trails & Monitoring: These systems will continuously be auditing who accesses PHI and report any inappropriate use in real time (Tembani, 2023).
• Incident Reporting Systems: Ensure that unintended disclosures are reported to compliance personnel in a timely fashion to facilitate timely response.
• Interdisciplinary Policy Development: Engage nurses, doctors, IT, and compliance officials in crafting easy-to-understand, actionable policies that recognize the realities of the ICU.

• Understanding what Protected Health Information (PHI) is, including any information that identifies the patient. In the ICU, even information that is “indirect,” like “last night’s trauma case,” is a violation of HIPAA if the patient can be identified.

• Implementation of policies, training, and utilization monitoring of PHI requires an interdisciplinary effort with the objective of providing patients with trust and safe care, but also ethical care nurses, physicians, IT, HR, and compliance officers all play a part.
